I am an aspiring mangaka from Australia!In 2019, I was published twice in G'Day Punch Manga Magazine (magazine is discontinued) with my oneshots Omnibeast and HuskHost. In 2023, I entered in the Silent Manga Audition competition with my oneshot The Bottle. In these Terms and Conditions, "I", ”me”, "my”, and “myself” refers to the artist. "Client", "you", “your”, and “yourself” refers to the end product user.
By placing a commission, you are agreeing to the following terms and conditions. If you require clarification on the terms and conditions, please contact me.
All commissions are delivered digitally.
I reserve the right to reject any commission for any or no reason.
The client is responsible for keeping back ups of their commission after delivery. I cannot guarantee that I will keep my own copy after the finalised file is sent.
I complete commissions in line with instructions given by the client and it is the client's responsibility to respect intellectual properties and/or copyright. I hold no responsibility for a commission infringing on intellectual property and/or copyright.
It is the client's responsibility to take any Terms of Service and Content/Community Guidelines of the website they plan to use the content on into account. I hold no responsibility for any broken rules, strikes, suspensions or bans of any kind.
Live2D commissions must be provided already cut unless a cutting fee is paid.
Rigging/animation quality heavily depends on the cutting of the files provided. I will not do additional cutting on provided files unless specifically requested and paid to. Please ensure the files are cut correctly. I can check over the cut artwork before rigging.
Delivery and Process
Full payment is required before the commission is delivered. The client has no ownership of or right to the commission until full payment has been received.
If you have a deadline, I must be notified when the commission is placed. I may reject a commission if I believe I cannot honour the deadline.
The client is able to ask for updates on their commission any time after the first payment. Updates will be given within 3 days. Please be advised that response times may vary due to timezones.
Illustration commissions are delivered as a PNG file. Commissions that require cutting for rigging/animation are delivered as a PSD file.
Live2D animation commissions are delivered as a gif or video file.
Live2D models/Vtuber models are delivered as a moc3 file. Cmo3 files/Live2D working files are not provided as a part of the commission.
Manga pages are delivered as a PNG format in a ZIP file.
Animations are delivered as a GIF or video file format.
Useage and Copyright
It is strictly prohibited to create NFTs out of my artwork.
It is strictly prohibited to upload or use my artwork to artificial intelligence models/software/programs/data bases.
You must not claim the commissioned artwork as your own work.
Commissions are not for commercial use unless agreed on prior and an additional fee is paid.
Commissions that contain intellectual property/copyrighted material that the client doesn’t have the right or permission to use are not eligible for commercial use.
I take no responsibility for infringement on intellectual property and/or copyright. It is the clients responsibility to respect the intellectual property and/or copyright of others.
Use of the commissions on social media, in streams and in youtube videos is allowed without an additional commercial use fee.
If commissioned work is sold to another party, I must be notified as to who the new owner is and the new owner is still required to follow these terms and conditions.
I reserve the right to use your commission as examples and promotional material for my services and for use in my portfolio.
Commissions may be posted publicly to social media upon completion. If you wish to keep the commission private, please state this at the start of the commission along with the privacy timeframe.
Refunds
No refunds will be issued after the artwork is complete. If the commission is not paid in full, the artwork will not be delivered and any prior payments are not eligible for refund.
Artworks that are not completed within 90 days of the upfront payment are eligible for refund and cancellation.
Artworks with a deadline set at the start of the commission are eligible for refund if the commission will not be complete by the deadline.
If I am unable to complete the commission for any reason, a refund will be issued and the commission will be cancelled.
If you require a refund, please contact me and I will issue it and cancel the commission if the artwork is not finished.
Chargebacks and refunds that break this policy will be disputed.
